Entraron en negociaciones a través de abogados para llegar a un acuerdo sobre cómo gestionar la nueva organización familiar con sus hijos, es decir, qué tipo de guarda y custodia, régimen de visitas, pago de los gastos, etc.
Por los medios de comunicación, se ha tenido constancia de la voluntad tanto de Shakira como de Piqué de no llegar a juicio y cerrar el tema amistosamente. Pero se han encontrado con dificultades en este proceso.
La principal dificultad ha sido la petición de Shakira de trasladarse con los hijos a Miami. Con el paso de las semanas se dio un cambio de las circunstancias. Piqué comunicó su retirada como jugador de fútbol. Al poco publicaron, diferentes medios de comunicación, que la expareja ya habían llegado a un acuerdo.

Este acuerdo consistía en atribuir a Shakira la guarda y custodia de los menores. La cantante y los menores se trasladarían a residir a Miami durante el 2023, sin especificar una fecha exacta. Ello motivado por el ingreso en un hospital de Barcelona del padre de la cantante.
Si es una guarda y custodia exclusiva para la cantante, eso quiere decir que Piqué tendrá un régimen de estancias con sus hijos. En concreto 10 días al mes, que se trasladará a la ciudad donde residan los menores para estar en su compañía y a parte los tres periodos de vacaciones escolares que tengan en EEUU. En estos periodos más largos de estancia podrá viajar con ellos a Barcelona para que tengan contacto con los abuelos y demás familiares paternos.
Para estas vacaciones de navidad, al estar ambos viviendo en Barcelona, se la repartirán por mitad.
Han dejado ya acordado una posible modificación de este tipo de guarda y custodia. Para el caso que Piqué, también se trasladara a residir a Miami la guarda y custodia pasaría a ser compartida.
¿Por qué no la han acordado desde ya? Porque no se permite una guarda y custodia compartida cuando los domicilios de los progenitores hay más de 30-40 km de distancia. Cuando Shakira se traslade a Miami se superará esa distancia.
